Terms of Use

These Terms of Use ("Terms") govern your access to and use of the website at crescent-enterprisesllc.com (the "Site") and the mobile applications Simply Nur and Nur Router (together, the "Apps"), each operated by Crescent Enterprises LLC ("Crescent," "we," "us"). By accessing or using the Site or the Apps, you agree to these Terms.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use our Apps or Site. By using them, you represent that you meet this requirement and have the legal capacity to agree to these Terms.

2. License

Subject to your compliance with these Terms, Crescent grants you a limited, non-exclusive, non-transferable, revocable license to install and use the Apps on devices you own or control, and to access the Site, for your personal, non-commercial use.

3. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or attempt to extract source code from the Apps except to the extent expressly permitted by applicable law.
• Copy, modify, distribute, sell, or lease any part of the Apps or Site.
• Use the Apps or Site in any unlawful manner or to harass, harm, or infringe the rights of others.
• Interfere with or disrupt the integrity or performance of the Apps, Site, or their underlying infrastructure.
• Use automated means (bots, scrapers) to access the Site or the Apps, except as permitted by our robots.txt or with our prior written consent.

4. Religious and Calculation Disclaimers

Our Apps provide prayer times, Qibla direction, mosque and halal-food information, and travel routing based on widely accepted Islamic calculation methods and third-party data sources. Prayer times are astronomical calculations that may vary slightly from your local masjid's posted times. You are responsible for verifying prayer times with your trusted local scholar or masjid, especially for ihtiyat (precautionary observance).

Halal designations for restaurants rely on third-party data and self-reporting; Crescent does not certify any establishment as halal. Verify independently before consuming.

5. Navigation and Travel Disclaimers

Nur Router provides route guidance, flight path modeling, and travel suggestions. You are solely responsible for safe and lawful operation of any vehicle or for following the instructions of flight crews, air traffic authorities, and local laws. Do not interact with the app while driving in a manner that violates applicable law. Flight path prayer times are estimates based on scheduled flight data; actual flight paths, altitudes, and timings may differ.

6. Subscriptions and Payments

Certain features of the Apps may require a paid subscription. Subscriptions are billed through the Apple App Store or Google Play and are governed by the terms of those platforms. Subscriptions automatically renew unless cancelled in your platform account settings at least 24 hours before the end of the current period. Refunds are handled by the applicable app store per its policies.

7. Intellectual Property

The Apps, the Site, and all associated content, features, trademarks, logos, and design elements (including but not limited to the Crescent Enterprises logo, Simply Nur, and Nur Router) are owned by Crescent Enterprises LLC or its licensors and are protected by U.S. and international intellectual property laws. Except for the limited license granted in Section 2, no rights are granted to you.

Quranic text, hadith, and religious content within the Apps are reproduced for educational and devotional purposes and are sourced from public-domain or properly licensed sources.

8. Third-Party Content and Services

The Apps and Site may contain links to or integrate content from third parties (Mapbox, Google, AeroDataBox, Apple, and others). We are not responsible for the accuracy, legality, or content of third-party services. Your use of third-party services is subject to their own terms.

9. Privacy

Your use of the Apps and Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

10. Disclaimer of Warranties

THE APPS AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. CRESCENT DOES NOT WARRANT THAT THE APPS OR SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CRESCENT, ITS OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APPS OR SITE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to defend, indemnify, and hold harmless Crescent and its affiliates from any claims, losses, or damages (including reasonable attorneys' fees) arising out of your use of the Apps or Site, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Apps or Site at any time, with or without notice, if we believe you have violated these Terms. Upon termination, the licenses granted to you will cease and you must stop using the Apps.

14. Changes to the Apps or Terms

We may update, modify, or discontinue features of the Apps or Site at any time. We may also update these Terms; material changes will be reflected by an updated "Effective date." Your continued use after changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State in which Crescent Enterprises LLC is organized, without regard to its conflict-of-laws rules. Any dispute arising under these Terms shall be resolved in the state or federal courts located in that jurisdiction, and you consent to personal jurisdiction there.

16. Apple App Store Additional Terms

If you obtained the Apps from the Apple App Store, you acknowledge that these Terms are between you and Crescent only, not Apple. Apple is not responsible for the Apps or their content. In the event of any failure of the Apps to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms as they apply to your use of the Apps on Apple devices.
